Charter agreements

All charters booked will be confirmed by a charter agreement signed by the charterer, the yacht owner or owner's representative and the charter brokers.

Terms And Conditions

The terms and conditions of Charter Agreements will vary, however most charters will be booked using a MYBA contract. Please click here for an example of a MYBA charter agreement

MYBA (Mediterranean Yacht Brokers Association)
The charter rate includes the hire and insurance of the yacht, crew wages, crew food, and ship's laundry.

WMT (West Mediterranean Terms)
The charter rate includes the hire and insurance of the yacht and the crew wages.

EMT (East Mediterranean Terms)
The charter rate includes the hire and insurance of the yacht, crew wages, crew food, ship's laundry, all running expenses such as fuel for four hours cruising per day, harbour dues, breakfast and lunch, but excludes soft and alcoholic drinks, dinner on board, communication costs and local taxes.

GT (Greek Terms)
The charter rate includes the hire and insurance of the yacht, crew wages, crew food. harbour dues within Greek waters, water, and ship's laundry.

CTI (Caribbean Terms Inclusive)
The charter rate includes the hire and insurance of the yacht, crew wages, crew food, ship's laundry, fuel for four hours cruising per day and three meals a day, but excludes soft and alcoholic drinks, local taxes, communication costs and dockage.

DEMISE & YSA
The charter rate includes the yacht hire and crew wages only, but excludes crew food and all additional expenses.

AYCA (American Yacht Charter Association)
Applicable to American flag vessels. The charter rate includes the hire and insurance of the yacht, crew wages, crew food, and ship's laundry only.

CHARTER RATES
The charter rates published are subject to change. Rates for special events, or charters of less than one week, might differ. Please contact Top Yachts for further information.

AGENCY FEES
All charter rates are inclusive of agency fees.

TAXES
Most charter yachts are commercially registered yachts and therefore no tax is due on the charter fee. However some charter rates will be subject to varying rates of tax depending on the port of registration and the cruising area.

SEASONS
High Season: July and August in Europe, Christmas and New Year in the Caribbean
Low Season: Other months

Payment terms

Upon the signing of the Charter Agreement a 50% deposit of the charter fee is required. The remaining balance, plus additional costs (see below) should be transferred at least one month prior to the commencement of the charter.

  • Advance Provisioning Allowance (APA):
    This is an advance on estimated expenditure of the Charterer. During the cruise, the captain will carefully calculate all expenses and at the end of the charter, a detailed statement of accounts and receipts will be presented to the charterer.
    If any funds are remaining they will be returned to the charterer. If there is an outstanding amount to be paid, this should be paid before disembarking.
  • Costs for charterer under the MYBA agreement usually include:
    Fuel costs for the vessel (main engines, generators, tenders, jet skis), food and beverages for the charterer and his guests, personal laundry, all communication costs, harbour and berthing fees, customs formalities, water, electricity, national and local taxes where applicable.
  • Delivery fees
    Cost of fuel and time which is for the charterer’s expense and can be charged if embarkation takes place at a port other than the home port of the yacht.
  • Fuel
    Certain flag vessels qualify for duty free fuel. This varies from country to country.
  • Gratuities
    Yacht crew will do everything in their power to ensure that you and your guests enjoy a successful charter. A gratuity (anywhere from 5% to 20% of the charter fee) is customary at the end of the charter, although this is not obligatory.
